1. General

All references below to d3 Audio & Visual Ltd or "d3av", should be taken to mean the limited company of d3 Audio & Visual ltd, a company registered in Scotland number SC290595, with UK VAT registration number 870 415 042.
By entering this site you agree to abide by the terms and conditions of use thereof. These terms and conditions are governed and constructed according to Scottish Law.
Although d3av will endeavour to ensure the accuracy of all the information within this web site, we shall not be liable for damages of any kind resulting from use of this site, or ordering therefrom other than as statutory duty requires.
Pictures shown are for illustration purposes only, and may not reflect exactly the current design of the product listed. All trademarks and brands, and their respective owners are acknowledged.
No variation to these conditions shall be binding unless agreed in writing between the Buyer and d3av. No terms and conditions put forward by the customer in conflict with these terms and conditions shall be incorporated into any contract unless separately agreed in writing and signed on behalf of d3av by an appropriate director.
By purchasing any product or item you are thereby agreeing to the herein stated terms and conditions.


2. Pricing

  1. Pricing and availability are subject to change without prior notice. Initial price shown on any product with variants is the lowest price for that item. The final price of an item will depend on the ultimate variant selected. Pricing will always be displayed at checkout showing the final cost of the specific item selected.
  2. Prices shown are web shop only prices, and may not be available other than for orders placed online. The title of the goods will remain the property of d3av until payment is received in full.
  3. Any typographical, clerical or other error or omission in any web page, document or information issued by d3av shall be subject to correction without any liability on the part of d3av.

3. Ordering

  1. By submitting your order you are offering to buy goods and allowing us to use your personal details for the purposes of supplying goods (including passing your details onto couriers and other subcontractors). Placing an order does not constitute a contract or imply acceptance by d3av of your order, but only a record of your offer to purchase a particular item at a particular price.
  2. After you place an order, d3av will determine whether or not to complete the order, and d3av may refuse or limit your order for any reason.
  3. For the avoidance of doubt, a contract will only be formed upon confirmation of dispatch of your order, which you will be notified of via email.
  4. Orders placed on-line will receive notification via email if we are unable to process the order. Rejection may be for a number of reasons including, but not limited to, goods no longer being manufactured by the supplier and goods currently being unavailable.
  5. All orders made from the UK are subject to 20 % VAT or current rate of VAT at time of purchase. Minimum order value £10.00 excluding carriage and VAT.

4. Payment

  1. To protect your security and prevent credit card fraud where possible, we reserve the right to ask for proof of ID and to carry out a credit check where necessary. We accept credit/debit card payments via Visa, Mastercard and Switch/Maestro. Credit card payments are debited at the time of order and made through PayPal.
  2. You may supply your credit card information via phone to a d3 online order employee through the main office number of 08450 043304. Do not submit credit or debit card information via email or fax as this is not a secure method.

5. Delivery Policy

  1. In the event that d3av are unable to fulfil an order within a reasonable time frame due to insufficient stock, the customer will be notified of an expected delivery date and, should this prove unsuitable to the customer, a full refund will be given 28 days.
  2. Delivery charges are itemised in the shop basket section for the UK mainland. Extra charges may be applied for Islands, remote areas, Northern Ireland, and for large orders. We will notify if this is the case. For international orders we will advise of additional delivery costs before dispatching your order. Costs will vary from country to country.
  3. Products are delivered either direct from our warehouse or from one of our stock logistics partners. Goods must be signed for on delivery; therefore they cannot be left with neighbours, in garages or at the back door etc.
  4. All delivery timescales given, whether in writing or verbally, are estimates as stated on the product page: If not stated then this would normally be 2-3 days. If your item is not in stock, we will back order for you and inform you of the expected delivery date. However, you will always be given the option to cancel your order if you would rather not wait. In the event that you wish to cancel your order, your credit card payment will be refunded same day or next working day through PayPal.

6. Delivery Damage

  1. If goods arrive in a damaged condition the customer must make a note on the carrier's delivery consignment note and contact us immediately. In addition we then require written notice of the damages within 3 working days - either by email, fax or letter. d3 Audio & Visual ltd shall not be liable for any losses, costs, damages, charges or expenses caused by any delay in delivering goods.

7. Returns/Refund/Cancellation Policy
General

  1. This returns policy should be read in conjunction with our standard Terms and Conditions which are detailed above.
  2. All Returns must be accompanied by an official RMA number ("RMA"), issued by d3 Audio & Visual ltd. Returns received without an RMA will be returned to sender upon receipt.


8. Faulty Goods

  1. Claims for damaged and faulty goods should be notified to us, in writing, within 3 working days.
  2. Returns that have not been authorised by d3 Audio & Visual Ltd will not be accepted. It is therefore imperative that written notice is received as per condition 9.1 above. Returned goods received which have not been authorised will be returned to the customer and no liability whatsoever will exist on the part of d3 Audio & Visual Ltd for any damage in transit.
  3. For faulty goods, replacements will be sent to the customer or alternatively d3 can arrange for a refund to be made.
  4. Where goods are returned which are found not to be faulty, the goods shall be returned to the customer and a handling charge of £30 charged to the customer.
  5. Where the goods become faulty out with the above period, and the goods are still under the manufacturer's warranty, the goods should be repaired under the terms of the manufacturer's warranty.
  6. All goods being returned under warranty must be returned in the original packaging, otherwise we cannot be held responsible for any damage in transit.
  7. All our goods are supplied with a minimum return to base warranty as standard, up to five years dependant on product purchased. It is therefore the customer's responsibility to return the goods should inspection be needed under warranty.

 

9. Distance Selling Regulations

  1. Under the The Consumer Protection (Distance Selling) Regulations 2000 (SI 2334/2000) ("the Distance Selling Regulations") private consumers within the United Kingdom are allowed a right to cancel their order. This does not apply to business customers.
  2. Goods that are custom made, or customised in any way, are not included within this scope of the Distance Selling Regulations. These goods cannot be returned or refunded unless faulty.
  3. If you decide to cancel an order, written notice must be given to us within seven (7) working days from the day after that on which you took receipt of the goods.
  4. Goods to be returned under the above regulations are required to meet the following requirements:

    • The item has been unused and is in the same condition as when it was sold. i.e. it is "as new". Thus if you have opened the box to examine the product you must have done so without damaging or marking the product or packaging in any way whatsoever.
    • The customer has to pay the return delivery charges.
    • The customer must ensure appropriate and adequate insurance cover is in place for the item in transit.
    • The goods have not been made to your own specification, or personalised in any way.
    • Goods are returned in a re-saleable condition and in their original packaging, as well as being adequately packed for shipping. This includes, but is not limited to, careless writing of addresses or sticking of labels on the packaging of goods.
    • All supplied manuals and accessories must also be returned, unopened.
    • Goods are returned as soon as possible, to ensure that we can refund your money within 30 days of receiving your cancellation notice.
  5. We shall only refund the cost of goods upon receipt of the goods at our depot for inspection.
  6. The product packaging must be protected against further wear or tear that may be caused in return transit. The Company reserves the right to charge for re-packaging of the product or any other costs incurred in returning the product to its original condition when despatched to the Buyer.
  7. If the above conditions are not met, goods will not be accepted by us on return. The goods shall be returned to you and we shall also charge your credit card for the value of the return carriage.
  8. If d3 Audio & visual ltd agrees to accept any Goods returned that are not in a saleable condition, it reserves the right to charge the full cost to the customer of bringing the products into a saleable condition.



10. Privacy policy
In order to operate its business d3 Audio & Visual Ltd will ask you to provide information about yourself. By engaging with d3 you consent and agree to us processing your data in the following manner. This privacy policy describes the information we collect and how we use that information. d3 Audio & Visual ltd takes this responsibility very seriously and will use the information only in accordance with this privacy policy.

1. Account Information
To open an account with d3 Audio & Visual Ltd you must provide your name, address, phone number, and email address. In order to make payments through the PayPal Services, you must provide credit card, debit card or bank account information. This required information is necessary for us to process transactions and  protect you against credit card fraud and current account fraud and in order to contact you should the need arise in administering your account or the PayPal Services.
We will also require other commercial and/or identification information if you send or receive certain high-value transactions or high overall payment volumes through the PayPal Services or as is otherwise required in order for us to comply with our anti-money laundering obligations under European law.
Data Protection Policy  In line with the act all d3av customers have the right to know what information is held about them and can access this through the Managing Director, Unit 4 Inchcape Place, Perth, PH1 3DU. The Act also requires d3av  to make sure that the customers information is:

Fairly and lawfully processed
Processed for limited purposes
Adequate, relevant and not excessive
Not kept for longer than is necessary
Processed in line with the customers rights
Secure
Not transferred to other countries without adequate protection

2. Transaction Information
In order to facilitate a transaction we will hold on file all relevant information in regard to the transaction consisting of customer details, order description, order amount and payment type (Credit card/account/ bank transfer etc). We do not hold and cannot access any credit card information (except the last four digits and expiry date) as this facility is done through the Secure Payment Process by PayPal  The only exception is if it is a credit card order by phone whereby we obtain the card details so that we can process the order over the phone through PayPals Virtual Terminal. NO details are held or retained beyond that transaction.

3. Internal Uses
We collect, store and process your personal information on servers located in the United Kingdom and operated by d3 Audio Visual and our third party supplier. Our principle purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customised experience. You agree that we may use your personal information to:
provide the services and customer support you request;
resolve errors, collect fees, and troubleshoot problems;
prevent potentially prohibited or illegal activities,
customise, measure, and improve our services and the content and layout of our website;
compare information for accuracy, and verify it with third parties such as suppliers and couriers

4. Customer Service Correspondence
If you send us correspondence, including emails and faxes, we retain such information in the records of your account. We will also retain customer service correspondence and other correspondence from PayPal to you. We retain these records in order to keep records of our relationship, to measure and improve our customer service, and to investigate potential fraud and violations of our User Agreement. We may, over time, delete these records if permitted by law.

5. Marketing 

We may on occasion use the information provided to us to inform you of updated services via e mail or catalogues etc. We will not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. However, in order for us to offer our services to our users; enhance the quality of our service from time to time; and protect the interests of our users, we will in limited circumstances share some of your personal information with third parties under strict restrictions, this is usually with suppliers & couriers to expedite orders for a speedy delivery service, and in the case of online orders: with PayPal.
